How long will it take to settle the estate?

The time to settle an estate varies, depending on the complexity of the estate or if probate is required. The legal review can take anywhere from 4 to 6 weeks, once all required documents have been received. 

Why does EQ Bank require every page of a will?

The totality of the information included in the will helps us to ensure we’re connecting with and accepting instructions from the right party in order to settle the estate. 

What is the estate settlement process when there is no will?

Each province has different approaches to when someone dies without a will (also known as passing “intestate”). Instructions for who can and how to apply to act as the estate trustee are cited within the applicable provincial legislation (all provincial legislation can be found online).

Please be certain to refer to the provincial legislation based on last place of residence relevant to the departed. If the deceased was a resident of Quebec, we kindly ask that you contact EQ Bank to discuss documentation requirements.

When is probate needed?

Assets held at EQ Bank in an unregistered savings account, and/or registered products without designation exceeding $50,000, will require proof of probate. Probate is a process whereby a will is verified in a court of law as a valid document that is the true last testament of the deceased.
